Terms and Conditions

These Terms apply to all contracts between adesso SE (“Operator”) and registered users via the DataMercato marketplace. Customer terms apply only if confirmed in writing by the Operator.

DataMercato is a B2B marketplace for data products (e.g. datasets, APIs, analytics). The concrete scope of performance follows from the respective product page. No physical goods are shipped.

Buy and sell features require registration. You must provide accurate information and keep credentials confidential. Organizations and memberships may create additional rights and duties.

All prices are in euro plus statutory VAT where stated. Invoicing is handled via the connected ERP where configured. An external payment-service-provider checkout is not part of the standard scope.

After a successful purchase you receive access according to the product description — typically via links, API endpoints, or documentation. Usage rights and entitlements follow platform and product rules (including status transitions).

The marketplace is primarily aimed at businesses (B2B). Where consumers are exceptionally involved, mandatory law applies. For digital content, withdrawal may expire under the statutory conditions.

Purchase grants only the usage rights stated on the product page. Redistribution, resale, or use outside the agreed purpose requires the rights-holder’s consent.

The Operator is liable without limitation for intent and gross negligence. For slight negligence, liability is limited to breach of essential contractual duties where permitted by law. Product content may originate from third-party providers.

German law applies. Venue is Dortmund where permitted. If any provision is invalid, the remaining provisions stay in force.
